On Administrative Supervision Of Public Universities

The administrative regulation is different from the traditional administrative intervention. The administrative regulation is administrative power to intervene the activity in the social and economic fields, and it intervene activities directly and keeping distance from the objects under the regulation. The administrative regulation to the public university that this paper discussed is based on the special attributes of public universities. The public university is one of China’s important public service providers, at the same time it is an independent legal person status of the organization. So the administrative power that intervene the public university in China has been divided into three categories:the macro-control, micro management and administrative regulation. But the scope of the three of them is not clear, and the administrative regulation is not completely established. That situation leads to the micro management is the only way to control the public university activities without regulation, and result in the abused administrative power has effect on university autonomy negatively. It makes unequal treatment between public universities and private universities. It is not conducive to the services in the field of competition in higher education. In view of the above question, this article discussed the overview, principles, scope, organization, methods, procedures and supervision of the administrative regulation to the public university separately. It might be helpful to the establishment of public university administrative regulatory system.
