Research On Legal System Of Medical Insurance Contract

Insurance contract, namely the insurance agreement, refers to the basic medical insurance agency (referred to as the insurance agency) for the realization of the insured’s service benefit, and signed with the medical institutions and pharmaceutical retail agency agreement. Insurance contract is the basic way to implement the basic medical insurance, health care institutions and medical institutions is the specification (including pharmaceutical retail enterprises) the main carrier relations, for the maintenance of the basic medical insurance of the insured lawful interests and rights, medical supply behavior norms of medical institutions to promote health, improve service level, promote the development of the basic medical insurance for me country and even the entire health system, has very important significance. However, the theory is still a lack of research on the insurance contract, insurance contract in practice understanding more confusion, the system also did not build the basic rules of the insurance contract, not only the implementation of the current medical insurance system and adversely affected, more is the inherent obstacles to the long-term healthy development of medical insurance system.In this paper, the long-term observation of China’s basic medical insurance based on operation, based on full investigation, analyses the legal nature of insurance contract, proposed to abolish the designated management system existing implementation of contract management, is studied and the medical insurance organization supervision rights and contract rights, health insurance contract rights and obligations of the configuration to conclude, perform, relief and protection of the rights and interests of the insured, insurance contract dispute law legal system, according to China’s national conditions and realities and the development trend of basic medical security system in China, many problems of medical insurance contract put forward constructive suggestions.
