Choice Of The Legislative Concept Of Ecological Civilization Construction

A series of problems flood the press such as air and water pollution, the denudation, desertification, species diversity and energy shortage, etc. They have already threatened the human living and its development. The eco-crisis sounds the alarm for the intoxicated people in the brilliant achievement of industrial civilization as the result of contradiction conflict between people and nature. As a result, the concept of sustainable development has shown us strategic direction. Eco-civilization, a new form of humanity civilization history, becomes the social model of sustainable development.The construction of eco-civilization is a complicated social system engineering. As a behavior norm implemented by national compulsory dint, the construction of eco-civilization is unavoidably companied by laws and systems. Without systematic law's protection and promotion, it could not be carried out. It is the essential demands of eco-civilization construction to make the concept of eco-civilization penetrate into the practice of eco-civilization's legislation to ensure its healthy and orderly development with the support of laws. While any legislation must be supervised by a certain legislation idea in its making procedural, it embodies the value of the law and make it clear to achieve the goal of the law. Ecological legislation idea reflects the recognization of legislators to focus on the ecological environment problems, and it is one of the closest contact areas to the ecological civilization. The direction function of the choice of the idea to the eco-civilization legislation can not be neglected.Recently, there exist two current of thoughts juxtaposed in the eco-legislation idea: anthropocentrism and non-anthropocentrism. The former is the self-centered view gradually formed about the position of human being itself in the universe, its rationality ought to be recognized, and its blemish ought to be realized too; the latter is a new form of eco-ethics based on the introspect and criticize to the former, it provided a lot of creative opinions for people to resolve the environmental problems of the present-day world, however, its inner philosophical paradoxes has caused numerous controversies. This papers hold a point of view that:scientific eco-legislation idea should not only admit human's ego-benefits, affirm the rationality of the pursuit of development, but also respect the nature's right and value fully, working hard to carry out the harmonious between human and nature——that is the content of the eco-anthropocentrism. It has manifested the unification which the dialectical materialism doctrine that everything has two aspects and discusses with emphasis, it has also manifested surmounting and the impossible contradictory diagnostic method. Under its guide, the legislation of eco-civilization will obtain more rationality and possibility. Newly formulated and promulgated law, the Circular Economy Promotion Law of the People's Republic of China shows this idea goodly.
