The environment problem which is affect the survival and development of human society and causing serious harm to society, is accompanied by the gradual formation of economic development. After rebuilding ecosystems, such as air, water, land, minerals, human remains, nature reserves, National Park, we have ensure the future development of resource requirements. These areas are collectively referred to as "Protected Areas",we through law or other effective means to manage in order to provide long-term economic benefits for human and environmental interests of the region. At present, the performance of human-induced environmental in the protected areas is over-exploitation of resources and biodiversity loss, the residents living environment is threatened, restrain the economic development. Because China is still a lack of clear legal framework of Protect Areas, and the use rights and management rights of Mineral—Hydroelectric resources is not reasonable in the Protected Areas. Actually protected areas system is not classification in economic and cultural development, so the resource development and environmental protection have become important problems.This article is based on The World Conservation Union (IUCN) Environmental Law Conference sixth research theme—"poverty alleviation and environmental protection issues" in 2008, according to government issues "the unity of Scientific Research of economic and environmental in Lanping, Yunnan Province". It's directed poverty-stricken typical areas as Lanping, including environmental legal issues and specific research in Mineral—Hydroelectric resources development. We tried to research the methods using of cost-benefit analysis in environmental economics and technical quantitative model in legal economics to build evidence-based analysis. There are five parts in the thesis:The first part is the theory of Protected Areas, introduce Protected Areas law, the Mineral—ydroelectric resources development theory and research methods. The legal system research on the basis of scientific argument.The second part is the part of asking question. This part deal with Protected Areas of Lanping Mineral—ydroelectric resources development which is faced with environmental problems and the legal issue. Asking the questions about Mineral—Hydroelectric resources development problem is lack of the responsibility system, the management system with low level, and authority of management is uncertain and laws and regulations is inefficiency and so on.The third part is the part of analysis question. This part draw on the experience of international legal provisions related to protected areas. The Mineral—Hydroelectric resources development must be protected by recycle resource and property rights, and protecting the biodiversity and diverse cultures, concern and respect right equal in Protect Areas.The fourth part is the part of the solving problem. We try to analysis the necessity and feasibility of Categories Management of IUCN in Lanping. This part is base on the internal demand of economic and social development, building an effective management system of protect area, improving the "Protected Area Act" (draft), strengthening effective legal-system for mineral resources and hydroelectric resources. The resource development and environmental protection of the legal system should strengthen supervision and management, and clearly define responsibilities and raise the utilization rate of Mineral—Hydroelectric resources.The fifth part is try to extended experiences of Protected Area management and the legal system to the province of resource-rich and poor areas in the western of China. We hope Lanping become to the green zinc-city of china after rational using natural resources. Our ultimate goal is balance the efficiency of economic, social and ecological system.
