The Power Of Environmental Ngos In Environmental Governance

As the development of Chinese economic,the interests become more and more diversity,the social affairs become more and more complexity,the requirements of public to the capacity of government to providing services have become higher,at the same time,the social problems break out in diversity ways.The by-product of economic that environmental pollution become more and more serious,the pubili pay attention to it seriously,and the quantity of Environmental Group Events rise more and more fastly to the public.The capacity of government dealing with the envirnmental affairs can not meet the requriments of the public which timely and fully meet the people's diverse needs of growing interests.Sense of civic self-government environmental protection has been strengthened in the movement.Civil society has grown with the economic development ,the public challenges to the Government's management.The dual condition of the society and country ,leading to power is no longer belong to state authority exclusively.Power needs to re-allocation between state and society. The traditional definition of power is no longer suitable for the needs of diverse interests, the concept of power need a revolution. Power is no longer limited to be devided the executive, legislative and judicial power, but rather based on the power of the initial state,that the national state has not yet been produced,the status that power is from right of people.This papers According to different subjects,divideds the power into Social Power and State Power.State Power is organized and exercised by the state government , and Social Power is exercised by subjects of civil society,the subjects of the power include citizens,non-governmental organizations, but for some order and efficiency requirements, mainly exercised by non-governmental organizations.This paper puts civil society and Social Power as a starting point,proposed the power analysis of environmental Non-governmental Organization in the environmental governance.This paper consists of five parts, the first part is an overview of environmental NGO, based on the practical level, the role of environmental NGO, to the definition and characteristics of its refining.environmental NGO has the characteristics of non-government,which maintain a neutral stance to deal with disputes in environmental requirements; environmental NGO has the characteristics of cooperation, which is superior to the Government that it can deal with environmental disputes, it can cooperate with the government, enterprises, co-victims of pollution, make the communication smoothly; environmental NGO has the characteristics of coordination ,that is advantages to approach to environmental disputes flexiblely;environmental NGO has the characteristics of profession, its organizers are generally experts in the field of environment, and concerned about the social and environmental problems of the media workers, also contends the environmental protection volunteers, these created a huge resources in manpower, material in the field, also the basis of empowering environmental NGO; Finally, environmental NGO has the characteristics of broad public foundation, which can protect the environmental NGO to get the information extensively and timelinessly,it just has made up between government and citizens of information asymmetry on the environment.The second part defied the power of environmental NGO in environmental governance, first defied the concept of power, the classification of power, the nature of power, The power of environmental NGO in the environmental management is defined as a social power, in essence, using the influence theory to analysis power, that environmental NGOs based on having the social resources to make impact on other subjects, that is the power they have; Secondly, describing the nature of Social Power to mate with environmental NGO in rationality. The third part descrbes the basement of authoriting the environmental NGO power,mainly through the legal basis,rational basis,realistic basis and international practice to describe.The fourth part descrbes the exercise of the environmental NGO power in environment governance,based on the definition of the power that analysis using the influence theory,and designs of three types of power exercising,that is the power of influence policy,legislation, the power of influence enforcement ,the power of influence judicial ,as well as analysis the relationship between the power of environmental NGO and government.The fifth part designs the supervision mechanism of environmental NGO's power in the environmental management,including the supervision of organs of state power and social forces.Last part is the conclusion, summarizes the views of the text, but also put forward for this new mode of governance concerns.
