Legal Regulation On Modern Agricultural Environmental Issues

Accelerating the development on modern agriculture is not only an essential content of the transformation of economic development and an important part of building a moderately prosperous society, but also the inevitable requirement on improving agricultural production capacity, increasing farmers’ income, building a new socialist countryside. Since the 16 th CPC National Congress, the Central Communist Party adheres to solve the issues to concern agriculture, countryside and farmers as the most important task. Deep reform in countryside and improve the rich peasants benefiting the agriculture policy with a substantial increase in investment in agriculture is a strong impetus to accelerate the transformation from traditional agriculture to modern agriculture. At present, China is facing a series of challenges that industrialization and urbanization developed rapidly but agricultural modernization is behind. The natural disasters occure frequently and agricultural infrastructure is weak. The resource and environment intensify constraint. Agricultural labor quality needs to be improved. The application of scientific and technological innovation capability is not strong, the production and operation is a small-scale. Agricultural social service system is not perfect and the degree of organization is low. Therefore, the development of modern agriculture is facing a more external uncertainty in our country.It is proved that the deeper of the degree of industrialization, science and technology, or outside on the matter and energy as a natural process of reproduction and economic reproduction of agricultural intervention, the more its destructive power of natural ecosystems and agricultural environment gets by theory and practice. Modern agriculture based on the support of intensiveness, chemical technology, irrigation, mechanization, facilities-based, bio-technology and its production methods, concepts and industrial technology system are facing the challenge of issues of sustainable development. It looks grim unprecedentedly and intensly. It should not be underestimated.In this paper, it is based on the situation of the development of modern agriculture and the various systems of Agricultural Environment Resources Protection Act in China. It analyzes systemly the state of the environment of modern agriculture with its environmental protection legal system and domestic legal using experience with its existing problems. And some researches on advanced foreign protection experience. The foreign legal systems in the agricultural environment protection we learn are that: The first is special legislation of agricultural natural resources; the second is comprehensive agricultural environmental legislation; the third is development of agricultural environmental protection legislation; the forth is agricultural environmental tax system. According to the current situation of our country, it is proposed some measures to improve the legal system on modern agricultural environmental protection in our country. They are as follows: Firstly, we should improve the legal system on modern agricultural pollution and develop an agricultural environmental protection laws to ensure the quality of legislation, strengthening procedures and scientific in agricultural environmental protection legislation. Secondly, we should practice actively the principles on sustainable development, public participation and environmental pollution prevention on modern agriculture. Thirdly, we should build a tax system on modern agricultural environmental as well as genetically modified organisms(GMO) Protection System on controlling environmental pollution.
