On The Moral And Legal, Of Honesty And Credibility

Good and faith is an important component in ethical tradition of China. In the course of development of the Chinese society, the ethic of good and faith plays an irreplaceable role in standardizing the social relationships. However, in the historical process of our country's transition from a traditional society to a modern one, a variety of crises in good and faith have emerged, which makes not only a topic for people to discuss in social life, but also a research focus in theoretical and academic circle. This paper is of certain significance theoretically and practically, as it integrates the need to set up a sincere society, digs for the meaning of traditional good and faith, analyzes the important role the good and faith has been playing in contemporary society, points out the moral nature in legal principles of honesty and trustworthiness, and puts forward the method to construct the good and faith in society. The content is divided into four parts, which is as follows:The first part probes into the implication of good and faith as China's traditional ethics. "Good and faith", whose original meaning is "getting rid of absurdity and deceiving", and which is the unity of truth and kindness, has China's ancient philosophical implication. As the criterion for people's behavior, "trustworthiness" has the tendency of "matching one's deeds with his words", "keeping promise". At the same time, "trustworthiness" is also the manifestation of "ren", and its meaning is close to "justice". But "good and faith" and "trustworthiness" bear an identity in essence, both implying honesty and without deceiving, truth and without deception. Nevertheless, they comparatively have a slight difference: "good and faith" makes the basis of "trustworthiness", while "trustworthiness" is the expansion of the "good and faith" in behavior.The second part expounds that the good and faith is the nature of ethics from three aspects: good and faith as the cornerstone of ethics, good and faith as the foundation in contemporary harmonious society, good and faith as the keystone in the construction of socialistic ethics. Integrating the necessity of building a harmonious society, this part focuses on the important role that good and faith plays in modern politics, economy and interpersonal relationships.The third part discusses that as a legal principle, good and faith is used both in western laws and in the laws of our country, but the good and faith per se is the legalization of ethical criterion, with an internal claim for ethical good and faith. This part also demonstrates that their interrelationships exert an influence on the society, which is an original idea in this paper.The fourth part has probed into all sorts of phenomena that good and faith lacks in the economy, politics, culture field. On the basis of analyzing modern social sincerity lacks, it has explored how to construct the modern good and faith society, from strengthening the good and faith the moral education, and the legal system education, establishing the good and faith consciousness and improving legal system.
