A Study On The Constitution Of State Intervention And The System Of Legal Norm

The State intervention powers refers to the state according to law to regulate economic relations, limitations, regulation and sanctions of force with the public force. Due to the existence of market failures and other defects,state intervention in the market economy also indispensable. The most core specification of state intervention in the market economy is the power to regulate the exercise of state intervention. Regulate and control the power of state intervention is the basic ways to prevent and reduce state intervention failure phenomenon appears. At the same time, it can protect the rights and interests of market main body. Market economy is the legal economy. In the context of the modern economy, state intervention rights can not without legal protection and legal regulation. Therefore, from the legal level analysis of the structure of the right of state intervention and regulation system is necessary.At first, this paper studies the concept of state intervention powers, characteristics of state intervention powers, nature of state intervention powers. On this basis, proposed state intervention constituted by two core powers, which is market supervision and macro-control power. A detailed study in the chapter on the market supervision and macro-control power principle, properties, composition and exercise etc. The authors think that the two kinds of power from the micro and macro level revealed the essence of the power of state intervention and the basic rule of exercise. In our country, legal norms which regulated the state intervention rights is mainly for market regulation law and macro-control law. At present, in our country, market regulation and macro-control laws also exist legislative system is imperfect. Therefore, our country should take specific measures to improve market regulation law and macroscopic regulation.
