The reform of the state-owned commercial banks should be market-oriented, which results from its peculiar position in the financial system, its property rights structure, and its defects of management mechanism. The drawback with supervision of banks and bank legal system also add to the market-oriented reform. Because of the reasons mentioned above our state-owned business bank must carry on system innovation in carrying on the market-oriented reform. Follow the entry of the transnational bank opening to the outside world of financial market that our country promises under WTO background, China faces tough competition pressure by banking. Only by carrying on system innovation can you confront a person with the danger of death and he will fight to live state-owned business banks. The author holds that single property rights structure owned by the whole people not only prevents banks from becoming principal part of market in a real sense, but also leads to over administrativeness in the managements and supervision of banks, therefore, revolution on joint stock system within state-owned commercial banks, improvement of its management system and creation of marketization environment inspiration-oriented will be helpful to fundamentally solve the systematic defects of state-owned commercial banks. Under current situation, aimed at optimizing its joint-stock industrial structure, one feasible way is to build financial holding company; improving the structure of corporation governing of state-owned commercial banks is concerned about external and internal governing; as far as supervision is concerned, the author proposes using Basle Framework for reference, specifying the transition from administrative and regulative to authoritative and risk supervision; and the author also raise questions to the legalization concerning bank supervision.
