A complete insurance market should be composed of three parts: the insure, the insured or the insurant, and the intermediary. The relationship between them is independent and connective of each other. Different body has its own position in market and function. The intermediary in insurance market plays the role of bridge and ligament in exchange of insurance products. It holds the decisive position on communicating and harmonizing the demand and the supply to realize the currency and consumption of insurance products. In those developed countries with high extent of market principle and elaborate division of labor, insurance companies play only the managerial role of underwriting and capital operation. The agents and the brokers assume the canvassing step, and more than 80% risk assessment and claim settlement are passed to the assessors. Though the agent and the broker have held their positions in Chinese insurance market, the assessor, as one of the three pillars in intermediary market, keeps absent of duty for long-term. Since the second half year in 2003, the industry of insurance assessor has entered a developing phrase at a superficial high-speed because the CIRC lowered the entrance of assessment for the purpose of developing the intermediary, such as cutting down the registered capital to RMB500,000, and deregulating on limitation on human resource. As a result all lines of capitals poured into the industry, which created more disorder. Undoubtedly, it is not good for the continual, healthy and stable development in the long run.Based on the relevant research, this thesis utilizes the probing way of neoinstitutional economics for reference on analyzing the flux of claim system in China, and suggests some points on establishing a system about compensating assessors. In addition, the thesis discusses the questions on regulating insurance assessment and so on.This paper comprises six parts:Part I is introduction, mainly discussing the research purpose and means, research field and approach.Part II(Chapter I ) focuses on the summary on insurance assessment. This chapter starts with the developing trend and elaborates the background of creation. As an intermediary, the assessor possesses not only diversified service function, connector, and low cost with high efficiency of common intermediary, but also its own characteristics, which will be introduced in chapter III. In the line of experience in an assessor company, The author will describe the two main businesses in detail in the following two paragraphs, i.e. underwriting assessment and claim assessment, in order to be helpful to know the operation in insurance assessing companies.Part III (Chapter II) is a theoretical analysis. From the scratch of real demand of insurance assessment, The author utilize the neoinsititutional tool, especially the theory of system vicissitude to establish an inner mechanism about the reason and the way to resolve path dependency of tradition insurers with non-performance in claiming. In the end, this thesis concludes the fluxing trend is dominated by evolution from the social members with the gradual exit of governmental rules from system market.Part IV (Chapter III) analyses the legal obligation and how to establish the relevant compensating system. For the reason of trust-agent contracts between assessor and trustor, if the former fails to fulfill the contractual obligations, and trustor burden the unnecessary fares and lose, the assessor should undertake the legal obligation. This part defines the legal characters, the cognizance of obligations, and the elements of professional compensating system. Additionally, it points out to variegate the professional guarantee on the basis of our national situation.Part V (Chapter IV) discusses the standard, the principle, the goal and the means of regulation.
