Adr And Reshaping People's Mediation System With Chinese Characteristics

ADR is the abbreviation of Alternative Dispute Resolution, It is the general name of various kinds of Extrajudicial System. ADR is concerned by America in the first, then it is popular in some European countries, Such as Japan , Korea, Australia etc. Because of its many characters, such as its informality , superior traine and security etc, it demonstrates its outstanding vigor .China has already set up modern civil disputation as other countries, including Judicial System and Extrajudicial System. Decided by national cultural tradition and psychological quality, a large number of disputes among the people of our country are solved by way of ADR, mediation is more popular in our country. As the climax of legal system and lawsuit arrivals , mediation and the other ADR start to decline. However, the formal law and litigation It is difficult to match the social needs of dispute resolution , but a diversified dispute resolution system on the basis of rule of law is more match to the social needs and better to the continue development of legal system. In September of 2002, the People's Supreme Court and the judiciary establish and announces some documents about people mediation system, it may shows that the people mediation system is becoming to enter a kind of modernization and transformation, to melt into the world ADR current, and play new role in the rebuild of Chinese modern dispute resolution system.The article includes four parts.
