Multi-perspective Study. Transition Of China's Administrative Hearing System

The hearing procedure is a procedure that requires the national administrative organ to offer the interested party the chance to express opinions, propose evidences or initial arguments before the administrative measures was carried out, its essence is to listen to the interested party's suggestion. After 1996,when administrative penalty law of the People's Republic of China was issued, the scope of application of the administrative hearing procedure expanded gradually, and the function it played enhanced too.However, due to many reasons, Chinese administrative hearing is not so complete until now, there are lots of problems in the administrative system of China. So it is very necessary to undertake further research on Chinese administrative hearing system in order to improve the transparency of government's administrative activity, and to strengthen the objectiveness and justness of administrative organ, so to protect the citizen's just rights and interests effectively.This thesis attempts to use the research approach and achievement of law science, jurisprudence, economics and administrative ethics etc., to unfold the multi-vision analysis on China administrative hearing system under the linguistic context of transformation, and then bring out the author's own view on the position, problem and probable suitable measure of the administrative hearing system of our country at the present stage.Through the analysis of the above several respects, the article draws out it's conclusions that, for the view of politics, the administrative hearing system accords with the fundamental political system that "the people master there own affairs " of our country; From the view of modernization, it is the indispensable choice in the process of modernization of our country. From the view of economic, the administrative hearing may cause the reducing of administrative efficiency shortly, but according to medium or long term, its cost will be far lower than benefit. From the point of view of ethics, the administrative hearing is the embodiment of administrative personnel's ethics in the administrative practice too. At the present stage, it is the most urgent and important task that to establish and improve the administrative hearing laws and regulations system of our nation.
