Among countries all over the world, Japan has been famous for attaching importance to educational legislation. Laws and statutes on education are sound, all educational administrative behaviors which are implemented to schools have a legal basis , all who want to develop education,make educational reform , always regard educational legislation as the guide. Depending on sound laws and statutes,is the main reason that Japan promotes the development of educational enterprise rapidly. In the school system of Japan, the private institutions are not only occupying the absolute predominance on the quantity, but also occupy the superior ones on the quality. They have played a very important role in popularized and modernized course of private higher education in Japan. The private institutions in Japan can make such achievement as so; it has close relations to attaching importance to the legislation on private higher education with the Japanese government after the Second World War. After World War II, the Japanese government has established a series of laws and statutes on private higher education. Except such basic laws as "Constitution", "educational Basic Law" and "educational law on schools", etc., they made the special "law on private schools" in 1949. They issued "implement decree of law on private schools"and "implement regulation of law on private schools" (1950). Later, and "Law on private school promotion Union in Japan" (1952), "Law on Private School Promotion Foundation in Japan" (1970), "Accounting regulations on School corporation "(1971), "law on private school promoting finance " (1975), "Implement decree of law on private school promoting finance" (1976). By the middle of the seventies of the 20th century, Japan had already formed comparatively perfect laws and statutes system about private higher education basically. These laws and statutes are related to the nature of private institutions, registering, administration, financial administration, etc., and have given comparatively detailed regulation to the establishment, management, variation and dismissing of the legal representative person of the school, and such respects as the assistance and supervision to the school, etc. The establishment of these laws and statutes played an impartment role in following orderly and developing smoothly to private higher education and it also has some transplanting meanings to private higher educational legislation of our country.
