Development And Perfection Of Heads Of Administrative Responsibility

The chief executive responsibility system is a fundamental administrative system, which established by the Constitution of The People Republic of China in 1982.It is also an important part of the state administrative systems.According to this system, the chief of an administrative agency has the whole power of and takes full responsibility for this agency, the power is relatively centralized, and the chief has more discretion. So this system greatly benefits the improvements in efficiency and in management of administrative agencies. But this system also has obvious drawbacks. The knowledge and ability of the chief of an administrative agency are limited, the decisions made by the chief may sometimes be mistaken, and the chief tends to be arbitrary. More importantly, this plan is only provided in very general term in law, there is no information about the power, the responsibility of the chief. To promote administrating by law and to bring its positiveeffects into play, this system must be clearly and definitely provided in law.Besides of the introduction and the concluding remark, there are four parts in this thesis.The first part is about the basic theories of the chief executive responsibility system, in which introduces the basic content of the system in the context of the constitutional definition, explains the dimension and content of the chief responsibility. It is also about the necessary conditions for the chief to take responsibility.The second part is about the development of the chief responsibility system and inspiration. It contains the Britain's responsibility in the cabinet system, the presidential responsibility of the Unites states, the relationship between the chief system and the development of the responsible government. In this part we can conclude that democracy and efficiency are the spirit of this system.The third part is about the features and problems of the chief executive responsibility system. The background, the features and the meanings of the system. It also concerns the main problems of the system. The fourth part is about the countermeasures to solve the problems of the chief executive responsibility system of our socialist system. Such as clarifying the relationship between the personal responsibility and the leadership of the party; strengthening the work of legislation and enhancing the extent of ruling by law of responsibility system of administrative leader; exerting fully the supervising efficiency to administrative leader from state power organs.
