Anti-dumping Procedures Comparative Study

Chinese enterprises are sued for dumping frequently outside China while foreign corporations make dumping a lot in China,which are the major problems faced by China in international competition.For handling this issue,we must improve our anti-dumping legal system.Since the anti-dumping procedure plays an important role in anti-dumping law,it means a lot both in theory and practice that further studying the anti-dumping procedure.This thesis makes wide-range of comparative study on anti-dumping rules in US and EU and WTO with China's anti-dumping procedure,and searches for the gap between China and developed countries and finally brings forward some ideas about further perfecting our own anti-dumping procedure.Besides foreword and conclusion,the thesis can be divided into five parts:The first chapter is to do the comparative analysis in the macro-level with respect to the legislation model and legislation methods and the construction of legislatures in US and EU with China's anti-dumping procedure.The second chapter focuses on the initiating section of the anti-dumping procedure.The thesis concerns more on comparing qualification of the parties as well as the time limit of investigation in US and EU and WTO with what we do in China.The third chapter searches for the concrete differences and distinctions in the preliminary verdict and the ad hoc measures as well as the final verdict in a micro-perspective,and comes out of what we can learn from the legislation part of those developed countries.The fourth chapter does some comprehensive analysis on the administrative review and judicial review and find out the common places and different characters,in order to come up with some valuable and referential points for the establishing of China's anti-dumping procedure. The fifth chapter puts the attention on how we apply the conclusion of the comparative study on anti-dumping issue to our country's establishment of anti-dumping procedure law.The thesis put forward some peculiar ideas on the further perfection of anti-dumping procedure law.
