With the Copenhagen conference, the world climate issues also reached consensus on further demonstrated with our increasing emphasis on human beings are closely related to environmental issues. In this context, a revolving economic point of view to study the issue of China's energy legislation also show its significance. Energy is the survival and development of human society and material basis, but a long time, we have established a large number of the economy based on energy consumption, to energy development has brought enormous harm. In China, the lack of laws and regulations related to energy, but also the development of energy shackles worse. In-depth study of China's Energy Law of the legislative model and the system of choice, the purpose of writing can be reached as follows:First, help to ease the energy supply and security issues; secondly, will help curb energy pollution problems; the three will help protect the right to life and achieving China's sustainable development. In this paper, analysis method of jurisprudence, law, comparative analysis method and analog analysis, the right to conflict analysis, legal issues such as the type of analysis carried out in-depth study. Results and conclusions of this paper are:First, it should strengthen energy legislation, theoretical research, establish clear guiding ideology in the energy field to be fully applied in practice. Second, the emphasis on circular economy law, ideas and energy values of the fit, thus China's energy legislation to find practical ways to guide and effective measures; and third, strengthening China's energy legal system the right to internal and external mechanisms for coordination, for the establishment of a complete and unified legal system, the basis of the energy origin. I hope to explore these questions for China's energy legislation to make modest means.
