A Study On The Supervision Of Labor Disputes In The Pearl River Delta Region

Along with the increasingly improving rate of national economy and GDP, the number of disputes between workers and entrepreneurs are also improving rapidly in recent years, especially in Pearl-Delta region. The disputes are exposed to the solution from entrepreneurs cannot reach to the workers’ requirements on income, social insurance, and pension, which result in the workers feeling desperately disappointed to entrepreneurs, and as a result, workers turn to special resolutions such as going on striking to seek for way out. To explore the reasons, there exist imperfect industrial management system and incomplete executive methods within government and related department. And there also exists foreign labor organization to interfere within and enlarge conflict between workers and entrepreneurs. Therefore, although all levels from Guangdong Provincial Government and related department have thoroughly implemented the Labor Law and Trade Union Law, as well as establish Labor relation coordination organizations in Pearl-Delta region, the disputes between workers and entrepreneurs are still the most important Public Administrative Affairs for government to reinforce supervision and confront with in advance. This paper tries to raise feasible solutions to the above disputes on the basis of combing current situation of disputes between workers and entrepreneurs, governmental organization’s supervision situation, analyzing domestic and outside affecting reasons, as well as considering matured methods used by foreign governments on this issue. Especially after deeply analyzing the interior report on outlander Labor Organization’s interventions, this paper points out the complexity and hardness for government to resolve this issue, and also raises that Governments in Pearl-Delta region shall consider thoughts, mechanism and system into all, shall improve government’s supervision subject, supervision method, supervision mechanism and regulations, to strengthen governing on workers and entrepreneurs, shall also enlarge the combat on foreign labor organization so as to deal with disputes in advance. This paper tentatively raises out that Government in Pearl-Delta region shall act as a trial role on researching Labor relationship and resolving labor disputes, such as on the trade union function reforming, and finally seeking out a reasonable scheme.
