The Research On The Matters Of Planning Environmental Impact Assessment Legal System

Planning environmental impact assessment legal system is one of the most important legal system in the field of environmental protection in China, it has been played a huge role in the prevention and control of the environmental pollution and ecological protection.Planning environmental impact assessment system focus on the environment problems global and fundamental,and it constructs the regional environmental protection and ecological construction from a specific and overall angle, and combining with the national economic development plans. It also considers more mixed impacts of the construction projects, including cross influence, the cumulative effects factors and so on , and solves the environment questions on a planning level. The environmental problems in our country are caused by the unreasonable layout and structure of the plans, they could not resolve by one or more construction programmes alone, it must be resolved through optimization and adjustment of the plan on the initial stage, meanwhile, as for the problems of our legal system, the promote of the planning environmental legal system could not get the restriction and protection. This paper try to find the problems of the PEIA system in the practice by analysing the typical cases that happened currently, and try to find the further improvement measures.
