| With the end of the Cold War, peace and development have become two dominant themes of the world and the issue of national defense and security (NDS) becomes less important. In this context, one belief holds that there is no need for reservation of rare mineral resources (RMRs) for NDS because almost all resources are available at markets with economic integration and resource globalization. As in China's case, after entry into the World Trade Organization (WTO),the trade barriers with the world are becoming less and less. Is it necessary to carry out the relevant NDS policy of reserving the RMRs? To what extent of the policy if yes? What is on earth of the necessity?The thesis argues that RMRs is related to NDS and therefore it becomes an significant trend for nomocracy modernization to develop the RMR law system in accordance with the national interests in developed countries. As one of largest developing countries, it is the same significance to do so for Chinese government. Therefore, to clarify the necessity for the RMR reservation system and then how to impel development of such system through legislation has become an urgent research subject.The paper first outlines the present situations in terms of mineral resource exploration and protection in China, proceeding comparing the legislation system and policies in RMR reservation between China and some foreign countries like USA, Japan,and South Kore. Based on the analysis of present problem with China's legislation in RMR reservation, the paper gets insight of the legislation necessity for strategic RMR reservation in China. |
