Research On Chinese Legal System Of Emergency Disposal On Marine Environment Pollution Incident

Both the2010-USA Gulf of Mexico oil spill incident and the2011-China Bohai Bay oil spill incident cause great damage to the marine environment and economy. The Bohai Bay oil spill incident has reflected several problems in emergency disposal of marine environment pollution incident in legislation, enforcement and justice level.The paper compared the2010-USA Gulf of Mexico oil spill incident with the2011-China Bohai Bay oil spill incident, and elaborated the characteristics and harm of Marine environmental incident. After that, the paper analysis some problems existed in Chinese legal system of marine environmental emergency incident disposal in legislation, law enforcement and justice, then draw lessons from developed countries of their experience. at the legislative level, suggesting perfect early warning system and public participation system, regulate the legal liability set; at law enforcement level, the paper suggested adding restrict and supervision system in the government execution of information disclosure; at justice level, put forward the idea that widening the range of proper complaint in public interest litigation and make a case analysis of the2011-China BoHai bay oil spill incident. At last, make a conclusion of marine environmental emergency incident disposal in legislation, law enforcement and justice level.
