Ecological Compensation In China Legal System Research

Ecological compensation mechanism of the beneficiaries of ecosystem services to pay the fees to the provision of ecosystem services, ecological compensation legal system is the hope that through the establishment of sound ecological compensation legal system to implement this mechanism, the main content of this paper is analysis of ecological compensation system and the existing ecological compensation legal system, and finally the establishment of ecological compensation in China's legal system to put forward some of my views.This paper will be mainly from the four parts to expand the analysis, these four parts are the introduction of ecological compensation system and its theoretical basis, the current ecological compensation legal system, as well as recommendations on the legal system of China's ecological compensation.The first part introduces the research background of this article, dynamic as well as methods.The second part, focuses on China's ecological'compensation system and its theoretical basis, including an overview of ecological compensation system. The theory is based primarily on law and economics, two aspects discussed the basis of economic theory including the theory of public goods, externality theory, property rights theory, legal theory, including the concept of fairness and justice and fairness and efficiency theory of value.The third part of the main contents of the status of introduction of ecological compensation for the legal system and its shortcomings. This paper describes our current ecological compensation legal system, adopt a decentralized legislation and relevant laws and regulations are scattered among the relevant laws and regulations, and there is no separate system of ecological compensation legal system. And a brief introduction to the systematic, principled, normative, and specific management system and taxation system of the inadequacies of the current ecological compensation legal system. The last part of this article is to establish a sound of the legal system of China's ecological compensation put forward their own personal humble opinion, taking into account China's "ecological'Compensation Ordinance and has begun to develop, the paper recommended the establishment of an independent, comprehensive ecological compensation legal system, change existing fragmented system of ecological compensation legal system. Made a brief exposition of the framework of the legal system of China's ecological compensation system and its main content.
