The situation of the environment is getting worse and wore because of the global warming and the significantly increasing population. The temperature of our planet has risen by 0.3—0.6C since 18th century. Besides the sea levels has ridden by 10—25 centimeters. Therefore human race are confronting unimaginable challenges.Climate changing is one of the toughest problems facing the international community. The whole world is willing to have a agreement on the greenhouse gas emissions during the Copenhagen Conference. Nevertheless, we have not to reach such an agreement yet,with a non-bonding Copenhagen Protocol only. And before the Conference, several nations have made their own principles to express their opinions on climate change.America and France claimed that if the law of the climate changing would not work, they would take other approaches to protect their industries and prevent greenhouse gas emissions. Both of the two are seen as the "carbon tariff'in the global community and were believed as a sort of protectionism.Therefore, will the two nations take their carbon tariff actions because of the failure of the protocol? The author guesses that it is crucial to analyze these approaches.The wirer analyzes carbon tariff legal system by using methods of comparison and case analysis, dividing the dissertation into four chapters.In the first part, the backgrounds of the so called carbon traffic.The United States and France aim at stressing China and India to take the responsibilities of reducing greenhouse gas emissions. Then the writer shows the United Nations Framework Convention on Climate Changing and concludes that there are significant differences between the responsibilities of reducing emission. The industrialized countries must provide money and technology to help the developing countries.In the second part, the author analysis of "carbon tariff' in the author's opinion,it is essentially a kind of "green trade barriers". The author also presents the different opinions of the supporters and opponents of carbon tariff.The third part of the article further analyzed the tariff "fairness" and "validity ".with the relevant two cases, from duty concessions or national treatment principle, and has analyzed it from different angles.In the fourth part, the author analyses the impact of global economic development of the carbon tariffs.The author puts more words on the impact of the economic of China. Then the author suggests that we should make new polices to prevent further loss of the action of taking out the carbon tariff.
