A Research Of The Countermeasures To The Green Trade Barriers In China's Agricultural Product Export

The green trade barriers has brought a serious negative impact on China's export trade, especially agricultural exports, because of the growing face detection range and the increasingly stringent testing standards. By frequently encountering the trade ban, the export volume decreased significantly. The higher the technical issues of agricultural exports requires, the more heavy losses the agricultural products export enterprises to suffer. Therefore, the search for possible legal measures to break through the restrictions of green barriers is the issue needs to be urgently addressed.This paper introduces the basic theory of green-related trade barriers at first; some analysis is made especially for the legal basis and the performance, in order to reach a more comprehensive understanding of the green trade barriers. Then, from both the positive and the negative points the impact of green trade barriers on agricultural products. Thirdly, introduce the agricultural exports trade with the European Union, the United States and Japan. And from the real data, analyzes the positive and negative effects the green trade barriers bring to our exports of agricultural products. Finally, to make a breakthrough in the legal response of green trade barriers, the paper do some research in the international law and the domestic law.The significance of this writing is to reveal the substantial legitimacy and discriminatory of the green trade barriers, by large amounts of data through intuitive charts and reveals. And do research for the reasons for encountering negative impact form the green trade barriers, at last legal measures are proposed, in hope to enhancing the quality of agricultural products quality, and breaking through the green trade barriers.
