Research On The Precaution In Climate Change

As risk prevention has different operation modes and methods under different environmental issues. And it involves different conflict of interests. The paper put the risk prevention in the area of dealing with climate change to study its specificity in historical and comparative research methods.The paper is divided into three parts, the introduction, body parts and the conclusion.The introduction part introduces the meaning and background of risk prevention, its status and controversy in international environmental law. This part also points out the research direction of the paper.The first part of the body is the basic theory of risk prevention. Based on the international legal documents, this part introduces the origin and establishment of risk prevention, different attitudes and disputes of the international community. The second part of the body is about the specificity of risk prevention in the law of dealing with climate change. This part is focusing on analysing characteristics of risk prevention in dealing with global warming, protecting the ozone layer, preventing transboundary air pollution. The third part of the body combines the first two parts, pointing out the problems of the risk prevention and the solution of these problems. The last part of the body analysis impact on China's dealing with climate change. It also discusses the concept of risk prevention reflected in our laws and the legal, economic, energy security,science challenges it brings.The conclusion points out that explanation on risk prevention is always subjective which is inseparable from the national interests of different countries. China is a developing country whose energy structure is coal-based, with weak capacity to deal with climate change. So China should not recognize the risk prevention is becoming customary international law.
