Protection Of The Citizens Of The Right To Education Under The Constitution Of Sight

The right to education is a basic right of people in our country. From the aspect of application, Constitutional Code provides guarantee to the right to education of citizens. However, the unbalance of education resources, the bias of policy, and the education corruption in certain regions lead to the result that the popularization of nine-year compulsory education did not get the achievements we expected. Receiving education unfairly not only infringes the right to education of people, but also questions the equity and justness of our society. Whereas, our social security system is not efficient to protect the education right of citizens. Therefore, we need to think about how to fully guarantee the right to education of citizens to enable people to receive education fairly and equitably? How to solve the problem when the right to education is infringed? Unfortunately, citizens are the weak in front of these problems. In order to protect the weak, we must solve the problems at system level, thus to effectively protect the citizens'right to education, to realize the purpose of Constitutional Code about the right to education and eventually to promote the development of education and consummate the guarantee system of human right. With this in mind, first of all, in order to orient the right to education this paper discusses the definition, property and main content of the right to education. Furthermore, the basic guarantee principle of right to education, abroad experience and the protection stipulate of law of nations are learned. Finally affirm the accomplishments of the guarantee of our citizens'right to education combined with the real situation in our country. Additionally, the shortage of our guarantee system is found, and we intend to propose some improvement conceptions. We hope all of these could benefit the building of constitutional government in our country.
