How to protect and realize the equal right to education is always an academic and social problem that people from all walks of the wide should pay attention. Especially in the higher education equality, it is discussed again and again with the development and reform of higher education system. Although since the reform and open policy, our higher education system reform has made a great progress, the educational circles and higher education reform practices the essential rule of its series of beneficial exploration, and has achieved some positive results. But the current research of our country's higher education is still can not meet the equal right to education system reform and the protection of the practical needs. Existing prominent problems is, the works in light of the pedagogy, from the perspective of economics are too much, but short of from the law level, especially from the constitution and administrative law system to protect the level of higher education equality achievements in theory.Present relevant laws, rules and regulations, the provisions of the principle is lack of legal applicability, which cannot give full play to the law that should own utility in the reform practice. Especially in admit aspects and the allocation of resources, it lacks of unified law, makes all provinces, municipalities, local regions their own different admission standards, which is difficult to realize the equality of higher education. Therefore, I discuss the realization mechanism of this topic, and analyze the current system problems, and put forward some proposals for reform from the university entrance exam recruitment system and rights protection of higher education equality. We hope explore how to better protect the higher education equality from the perspective of the constitution and administrative law.
