Research On Problems In Chinese Professional Football League System

It has been thirty years since China started reform and began a policy of opening up to the outside world. This has resulted in great changes taking place in various fields. Only Chinese football has been at a low level for many years. Our football team is defeated in all competitions, which worried and distressed all the people. In ten years of Professional Reform, Chinese football has been brave enough to play the roll "needle of mine," which explore in some markets outside of the system. But under the surface of the false prosperity, Chinese football has lost the direction. Match-fixing, gambling, black whistle have taken advantage of the situation, and are rampant in the area of Chinese football. At the end of 2009, Liaoning Province, China's public security organs involved in football, thus blowing a storm of anti-crime crisis. The judicial intervention, determined and powerful blow have made the majority of fans clapping and cheering. But we wish the anti-crime crackdown management will be made conventional and not just rectification stage or just follow the rule by individuals. However, it is difficult to save the diehard football in China only by the self-discipline of the Chinese Football Association and clubs alone. Only rely on the sound system to protect the sweeping anti-gambling crisis, the project will last longer, and China's ugly and dirty football will be able to change.The author of this article used methods such as literature interview, expert interviews , comparative analysis, case analysis, logic analysis, etc, then constructional mainly in the following several aspects studying the problems about Chinese professional football league system in the view of the fight against the"match-fixing,gambling,black whistle".(1)The background of the"match-fixing,gambling,black whistle"problem in Chinese professional football league;(2)The supervision system of the"match-fixing,gambling,black whistle"problem in Chinese professional football league;(3)The management system of the"match-fixing,gambling,black whistle"problem in Chinese professional football league;(4) The laws and guarantee regulations of the"match-fixing,gambling,black whistle"problem in Chinese professional football league. This study aimed at finding problems existing in Chinese football professional league related system; providing theory basis and the suggestion to establish and perfect the system fighting against the"match-fixing,gambling,black whistle".This paper found:1.Chinese traditional "the ritual" governance concept, transformation from planned economy to market economy, the flaw of league system, the huge economic interests and legal norms are closely related to the rampant development of the"match-fixing,gambling,black whistle"problems in China's football.2. The lack of attention and support of public opinion supervision, football dictatorial powers, the lack of binding oversight mechanism, the referee supervision dummy, and the fatigue implementation of the industry rules and regulations which all accelerate the"match-fixing,gambling,black whistle"problems in China's football.3. The abuse of Chinese Football Association breeds greed and corruption, the dislocation of the management functions, weak penalties; the non-standard of club management and operation; the blind and lag of rules and systems aspects; absence management of Chinese football association on the referee; the vacancy of constraint mechanism.4. China's sports legal systems are imperfect, legal system construction behind practice, judicial intervention approach is not unblocked, and it is complexity to identify and apply laws to the facts of the"match-fixing,gambling,black whistle"problems in China's football.Finally, through analysis and comparison, this article made the following recommendations:1. We should improve the supervision mechanism, improve transparency in football, establish public system, and combine the various monitoring methods to form a monitoring force, strengthen supervision and improve the monitoring results.2. We should establish institutions to monitor the implementation of the Football Association to ensure the implementation of the system.3. We can set up the professional league by learning the advanced experience of foreign, and improve it with our actual.4. Football Association must have a clear position, according to a reasonable exercise of supervisory duties, to make the club have autonomy and the right to operate. We should establish independent investigation for processing of the"match-fixing,gambling,black whistle".5. We should develop special football law, set up an independent sports tribunal in the sports department, provide channels of appeal for the club and the players, and improve the sports arbitration system.
