The Research On The Legal Countermeasures Against Rural Garbage Pollution

With the speedy development of economy, the amount of the rubbish produced in our country has far more than the amount that we are capable of disposing, so garbage disposal problems have become problems and challenges faced by government of all levels. In the vast rural areas, rubbish pollution is increasely serious. Multi-source pollution including rural living garbage, industrial waste,agricultural residue waste and he unreasonable disposal has led to great pollution to the rural ecological environment; and influenced the physical and mental health of rural residents and the construction of ecological civilization gradually in China.The legal countermeasures against the rural garbage pollution is a series of legal measures that are taken to control solid or semi-solid waste generated by production and living in villages and towns. Perfecting legal countermeasures of preventing rural garbage pollution is the need to compensate effectively the deficits of the market behavior and administrative behavior in the process of managing rural waste. Which also is the need to build a new socialist countryside; and the urgent requirements of constructing rural ecological civilization and beautiful countryside.Based on the current pollution situation, the paper proceed from important theories, such as Circular economy, Environmental democracy and Environmental rights etc, and explore the experience on preventing and controlling rural waste from home and abroad; and introduce current circumstance and find the problems to perfect legal countermeasures of preventing and controlling rural garbage pollution. There are many problems about Rural garbage pollution in China, including discordant legislation, shortage of fund, lack of multi-controlling ways, failure of supervision mechanism,weak law-abiding consciousness and so on. Experience has proved that well management and control of rural waste pollution require a sound legal system. So in the paper, to improve the legal system for the prevention and control of rural garbage and realize the new harmonious countryside with sustainable development,the corresponding countermeasures and suggestions based on drawing lessons from the managerial experience from home and abroad are put forward to solve the current problems from legislation, supervision, law-abiding and preventing approach and infrastructure:improved laws and regulations, strengthening infrastructure construction, broadening preventing approaches, strengthening the preventing and controlling awareness of local government strengthening law supervision and the consciousness of law-abiding to finally achieve rural social harmony and development comprehensively based on "a clean village".
