Part-time employment has important practical significance to relieve employment pressure, But in our country, employee is lack of protections of law.The full text is divided into four parts.The first chapter analyses the legal basis of part-time employment. Part-time employment, is generally a flexible way of employment whose time is reduced to some degree. In our country, there is a labor contract relationship between the employers and workers. This relationship is different from the civil employment relationship, and also different from traditional full-time labor contract relationship because of its significantly weakened personal affiliated properties.The second chapter is Chinese current legal system. Current labor law seems to only emphasize on flexibility and convenience, reduction of personnel costs, but ignore the protection of laborers’ rights and interests, reflecting in terms of content:arbitrary of the labor contract form, almost no requirements on the contents of the contract, not clear Labor Standards Law, difficult applicability of current social insurance system.The third part is the exile legislative measures of part-time employment of and its enlightenment. Even in the developed countries, part-time workers pay is generally not high, however on the other hand will still benefit from the principle of equal treatment, to obtain the fair labor rights and interests. It is worth our country to draw lessons from.The fourth part is to improve our legal system of part-time employment. In order to protect the part-time employee’s equal labor rights, The law should adopt a written labor contract form, make clear the overtime’s legal nature and its computation method, set appropriate fired restrictions which is compatible with fired freedom, and establish a specific social security for part-time or other informal employees.
