Research Report On Sino-vietnam Border Residents’Marriages Legal Issues

Adjacent to the living on the frontiers of transnational marriages situation has long existed between China and Vietnam, the same language, similar cultures, lifestyle differences, the currency in the region of the border trade with each other free circulation. China-ASEAN Free Trade Area of the establishment, development and prosperity, and promote the exchange and integration between the two people in border areas. With the increasingly frequent exchanges between the peoples of China and Vietnam, the number of foreign-related marriage is rising. However, the current situation of Sino-Vietnam border residents marriages still exist some problems, and troubled by these issues for the management of government departments, but also concern for the people in border areas, hard and their vital interests. Therefore, this research report aims to understand the current situation and our legal cross-border marriages in China living on the frontiers more people in border areas in the application of the marriage status, further understanding of the relevant circumstances, and then find out the root of the problem, improve the legal issues of border residents marriages, transnational marriage and family to maintain Sino-Vietnam border residents stability and the interests of promoting legal construction of the border marriage.In the research, we have visited in Pingxiang City, Chongzuo Ningming nakan Township, related policies and data to understand the local civil affairs bureau, police station, conducted a cross-border marriages border residents family situation detailed interviews and in-depth understanding. Summed up the main situation of Sino-Vietnam border residents marriages through the data and materials:In recent years, with the improvement of living conditions in Vietnam and the economic recovery, the number of Vietnamese women married rural poverty is declining; but at the same time people in border areas to register The number of marriage were the trend of slow growth. Illegal marriage, not only in itself has many problems, it also brings many problems, mainly in Vietnamese women can not marry to acquire Chinese nationality; not conducive to ensuring the rights and interests of married Vietnamese women in China; a serious impact on social security management of the border areas; impact on China’s family planning policy and the stability of the family; illegal marriage caused great obstacles to the management of government departments.Through research and analysis, the reason for the existence of the illegal marriage is mainly due to economic restrictions on the level of the border areas; living on the frontiers of legal awareness weak and cumbersome cross-border marriage formalities. Thus, by analysis of the status and causes of the inquiry, I propose to promote the exchange of up and down, to understand each other needs; specification of relevant legislation, to strengthen bilateral cooperation; to strengthen the economic construction; enhance the cultural education, open border residents thinking; according to national characteristics, autonomy advantage to play4proposals.Sino-Vietnam border residents improve marriages legal issues, long-term peace and stability in the border region, transnational marriage and family happiness and stability, the overall progress of the management system of border marriage is conducive to building a harmonious socialist society with Chinese characteristics.
