Constitution Research On Conflict And Balance Of Public Interest And Individual Interest

About the view of public interest,it appeared in public law in our country. About public interest,there are different provisions in law in China:protecting public interest before making administrative acts,or a certain of compensation should be given to individual interest when public interest occupies individual interest.However, about public interest, both specific provisions and contents aren’t clear.In thus circumstances,it brings two results:for the purpose of public interest, executive branch may do harm to individual interest,or it can’t protect public interest in effect.Recently,with the improvement of right concept,people have more concern on private legal interest than before, therefore,the relationship between public interest and individual interest has been widely concerned.In our life, public interest often hurts individual interest.Therefore,the task is to solve conflict between public interest and individual interest at the moment.This paper analyzes concepts of public interest, individual interest and people’s private property in our country and analyzes different ones of public interest and people’s private property in foreign countries.From the Consitution and protecting private property which is filled with individuality,by contrastive study method,the paper emphasizes the Consitution study on conflict between public interest and individual interest and the Consitution principle and methods to keep balance between public interest and individual interest.The purpose is to deal well with the relationship between public interest and individual interest,thus,it can protect people’s private property to keep balance between public interest and individual interest.
