Research On Shen Jiaben’s Legal Education Thoughts And Application

Shen Jiaben was a famous jurist at the late of Qing Dynasty, he was the founder of Chinese law’s mordernization, and also one of the creators who founded the new-type law education in our country. During the process of presiding the legal reformation at the late of Qing Dynasty, Shen Jiaben put forward a series of legal education thoughts. What’s more, he put his legal thoughts into good use, with combining his doctrine and practice. He initiated a new-style model of legal education, which has profound and lasting influence for our country’s modernization of legal education.Since the Nineties’, the scholars from mainland have intensively carried out discussion and research on Shen Jiaben’s thoughts induringly, and have gotten rich achievements already. However, the research about his legal thoughts have not formed systematic theories up to now. And the research directions are also unevenly distributed. Currently, the research about Shen Jiaben around the academic circles mainly focuses on his research about Chinese adapt and the evaluation about his legal reformation. There are less researches on Shen’s legal education thoughts, which is also the significant component in his thoughts, and should not be ignored. This paper will take Shen Jiaben’s legal education thoughts as the research object, hoping to dig and detail his some thoughts and offering certain reference and inspiration for present legal educational practice.There are four parts in this paper.The part one, mainly referring Shen’s historical background and personal factors, discusses the generation of his legal educational doctrines.The part two, introduces the contents of his legal educational doctrines, which embodies three aspects:the new legal education can achieve our country’s rich and political thrive; the new legal education can protect Ann, and the country should reset legal doctors.The part three, introduces the practice in the legal education field, including sending people to study and inspect abroad, sorting and translating Chinese and Western legal texts, establishing legal college in the capital and initiating some law associations.The part four, with his era background and special status, evaluates the pros and cons of Shen’s legal educational thoughts. Meanwhile, in view of current disadvantages existing in our county’s legal education, puts forward to his thoughts’contemporary significance.
