| The legal system of the new rural social endowment insurance has great significance for the protection of the rural elderly, and plays an important role in the legal system of Chinese social security. As the first link and an important part of the rural social endowment insurance, a reasonable choice and effective implementation of financing determines the running and development of the new rural social endowment insurance system directly. It is great significance to make a reasonable regulation in the law for the fund-raising of the new rural social endowment insurance. The choice of the fund-raising of the rural endowment insurance should target to maintain the basic living of elderly farmers, and see the fairness and efficiency as its basis value orientation, and adapt to the socio-economic level after taking full account of other factors, as the population structure and trends, the degree of maturity of the capital market, and so on. The rule of law is the basis for the formation of social order. In recent years, although the state attached great importance to the rural social endowment insurance, and proposed that "The new farmer’s insurance" coverage in the rural areas this year, the legal that rules the rural endowment insurance completely and systematically isn’t formulated so far.
