The Countermeasure Research Of Promoting Our Country Marine Administrative Execution

With the development of social economy, the economic activity of humandevelopment and utilization the ocean is more and more frequent, causingincreasingly serious pollution. To protect the marine environment, promote thesustainable development of marine economy, we need to constantly strengthen themanagement. In recent years, China’s maritime administrative law enforcement ispaying more and more attention to the ocean management and increasing oceanadministration efforts. In the marine environment protection, they have made someachievements. But at the same time, make no in disguised forms, execution and otherexecutive fatigue phenomenon exist in the administrative execution process seriouslyrestrict the marine executive efficiency. Since March2006premier Wen Jiabao firstput forward the concept of “the government execution” on the tenth National People’sCongress four meeting, academia started widely discussing the government execution.But at present, Chinese academia has hardly yet researched on marine administrativeexecution. In view of this, this article, based on the analysis of the literature material,by putting forward the problems, analyze and solve problems logic thinking definesthe concept, characteristics, discusses present situation, analyses problems exist inmarine executive process, and puts forward the method of ascension path, to providereference opinions for state and local marine administrative organ and its personnelimproving administrative execution ability, so as to improve the efficiency of China’socean management.This article is divided into five chapters. Chapter1is mainly about conceptsdefining and theoretical analysis. Through carding the academic definition ofgovernment executive ability, combined with the characteristics of ocean management,the article put forward the concept of marine administrative execution ability and itscharacteristics, and analyses the applicability of the public choice theory and integritymanagement theory on researching the marine administrative execution ability.Chapter2discusses four elements of the marine executive ability, which are theexecution of the system mechanism, enforcing subjects, the material conditions ofimplementation and execution environment, and their relationship. Chapter3, thisarticle summarizes the present situation of the marine administrative execution ability.At present, our country related laws and regulations of marine administrativeorganization have been improved. But at the same time, fatigue phenomenon, such asimplement in disguised forms, the implementation of the execution remains relativelyserious. Replacing the execution, choosing to perform, symbolic execution,perfunctory execution and other phenomena greatly reduce marine executiveefficiency. Chapter4discusses the cause of executive fatigue from the execution ofthe system mechanism, enforcing subjects, the material conditions of implementationand execution environment four aspects. Chapter5, based on overall analysis of China’s ocean administrative fatigue phenomenon and summarizing foreign countriesexperience, using the public choice theory and the integrity management theory, thispart puts forward the solution ways and means form “software” and “hardware”aspects. On the software side, need to improve ocean law system, strengthen thecomprehensive coordination management, perfect incentive mechanism andsupervision mechanism, and improve the marine environmental protectionconsciousness, strengthen education training, improve law enforcement’s professionalquality ability, strengthen the administrative execution culture construction. On thehardware side, need to speed up united function sea law enforcement teamestablishment, increase the funds investment, improving technology, improveequipment level, construct the management information system.This article through analyzing the domestic and foreign books and papers aboutexecutive ability, ocean law enforcement management, marine administrativemanagement, marine environment management, ocean policy execution and otheraspects, putting the marine administrative execution ability as the research object,synthetically studies the concept, the characteristic, the elements, the current situation,the promotion methods of marine administrative execution ability. The research on themarine administrative execution ability is comprehensive and comprehensive. At thesame time, this paper also exist deficiencies, such as lack of certain practicalinvestigation, the present situation of understanding may not be thorough, proposedcountermeasures lack relevance. I will continue to focus on implementation situationof marine administrative execution ability at home and abroad, and in the conditionsallow, make deep surveys and studies, to deepen understanding of the presentsituation of the marine administrative execution ability.
