Nowadays, with acceleration of modernization of human society and highlyprosperity of industrial civilization, human beings grab interests from nature greedily,meanwhile, sacrifice natural environment greatly.The climate warming brings greatthreats to human being’s existence and development. In order to cope with globalwarming and deterioration of environment, the United Nation framework conventionon climate change and Kyoto protocol which passed later set up standard and criterionfor human beings to protect climate and environment of the earth. Kyoto protocolmade some innovative intuitional design to replace impractical parts of the UnitedNation framework convention on climate. It not only states legislative principle ofinternational economic law but also divides the countries into annex I countries andannex II countries. This kind of criterion of classification improves the operability ofmechanism of keeping an appointment. Clean development mechanism is the mostsustainable long-term mechanism in three flexible mechanism which can supportdeveloping country’ further development mechanism. Firstly, this article will studythe foundation of the theory of the law of the Clean development mechanism and theorigin of the theory, will compare and analyse the operating mechanism of the cleandevelopment mechanism under macroscopic background. Then, it will make practicalanalysis from some typical countries in annex I countries and annex II countries. Italso makes case analyses of law, regulation, institutions of every country’s cleandeveloping mechanism and provides some precious experience for application of ourcountry’s clean developing mechanism on the basis of summing up practicalexperience. From the angle of perfecting law system of clean developing mechanismand strengthening the risk control of clean developing mechanism, it analyses theexisting defects in the clean developing mechanism and gets to know urgency ofperfecting relevant law of clean developing mechanism. Then, to see phenomenon,analyze it, find solution from the current situation of china’s clean development,Taking operation management method of clean development mechanism project foran example, analyze the double risks of real transaction and law, regulation, institution in china’s clean developing project. So it is very important to provideameliorative suggestion to china’s clean developing mechanism. At last, it analyzesthe approach of post Kyoto age and its effect to future development of cleandeveloping mechanism, how to face the changing situation and prospect.
