The Research On Legislation Of Chinese Small And Medium-sized Enterprises Investment In Africa Non-energy Industry

With the rapid development of economic globalization, Africa has become a hot globalinvestment area, and it is one of the major investments of Chinese enterprises. But we will find thatChinese small enterprise invest in Africa non-energy industry slowly comparing the rapiddevelopment between china-Africa trade. There are many reasons to Cause this phenomenon, suchas lack of technical advantages, capital, and so on. The further reason is that Chinese enterprisesdon’t know relevant policies that Chinese government encourages them to invest in Africa. Atpresent, the domestic academic circles research less of legal environments of investment in Africa.Under the above background, this article attempts to analysis of the legal environment ofinvestment Africa, and puts forward some suggestions about solving these problems. This articlehas analyzed the overview about Chinese small and medium-sized enterprise investment in Africanon-energy industry, according to the historical development, the industry distribution,opportunities and challenges of China’s investment in Africa. Second, it has described the legalenvironment of small and medium-sized enterprises investment in the non-energy industry,including African legal situation, overseas investment in existing legal norms in our country, theother policy supports to invest Africa in overseas, the small and medium-sized enterprises faced thelegal dilemmas. Among them, it analyzed the legal environment problems of small andmedium-sized enterprise investment in Africa. One is ambiguous about the laws of investment inAfrica. Two is lack of the statute law about investment in Africa. Three is imperfect tax system.Four is trivial administrative and approval system. Five is unclear BITs between China and Africa.Six is lack of protection of BITs to the small and medium-sized enterprises. Finally, it has proposedto structure support system about the small and medium-sized enterprises investment in Africa. Oneis Perfecting the legal system. Two is to establish overseas investment law as soon as possible.Three is to set up a public service function and establish relevant service functional foremanship.Four is perfection of financing system. Five is to establish overseas direct investment insurancesystem.I hope to study in-depth on investment of small and medium-sized enterprises in Africanon-energy industry, with drawing lessons from domestic and foreign advanced theoretical resultsand Chinese realities. And further found the ideal win-win situation in cooperation with Africa.
