The Research On Legal System In Higher Vocationgal Education

Higher vocational education has been running into an express way since the3rd national education conference made an issue to vigorously develop our vocational education in1999.In September,2010, the national vocational education reform conference held in Hangzhou proposed that we should fucos on quality improving with a main course of cooperative-based school running, educating, employment and development; and we should constantly deepen teaching reform, further advance the innovation of the educational system to construct a modern higher vocational education with Chinese characteristics. As a result, higher vocational education has been enjoying its profound development ever since. As a new type of higher education in the national education system in our country, higher vocational education, with a fast development in recent years, has nearly taken a half share of our higher education and it serves as a major strength to train advanced qualified and technical talents with particular skills. However, comparing to its rapid expansion on scale, the construction of its relevant theoretical foundation, laws and regulations falls behind. In order to offer a legal guarantee for its healthy and sustainable development, it is crucial for us to follow the principles of higher vocational educational to improve its legal system. There is not an independent law available in our country at present which offers an overall regulations for higher vocational education.Besides, the existing clauses,regulations and laws relevent to higher vocational education are usually too general in content,too seriously principled too abstract and they are not instructive and workable.As a result, it is difficult for them to function as a regulator and facilitator in the development of higher vocational education.Therefore, in order to maintain a healthy and sustainable development of vocational education, we should constantly establish and revise its relevent legal foundations. We also should adopt and integrate the universal experience of oversea countries with the reality of what we have to creat a new way with our own characteristics while developing our legal system for higher vocational education. Refering to the fall behind, scatterness and softness of the current laws of vocational education, We should pay especail attention to finding out its key contradictions in law construction, specialise and systematize the construction so as to make them more instructive and workable. In such ways we can make laws for vocational education authoritative and with epochal character, thus to creat a better environment for laws construction of vocational education.
