Global climate changes have attracted increasing attention of the world. In response to rising global temperatures and climate anomalies all over the world, many countries have adopted measures to control greenhouse gas emissions. As a responsible country, China is committed to controlling greenhouse gas emissions, and developing the low-carbon economic.At present, China’s carbon emissions trading include the clean development mechanism and voluntary reductions of domestic enterprises. The development of Clean Development Mechanism in China is more mature, the state has enacted the relevant legislations to support its development. But the Clean Development Mechanism in China’s development suffers some troubles, such as the clean development mechanism project partners’ status is unequal, it lack of initiative; The application procedures of Clean Development Mechanism project is complex and the cost of application is huge; For the operation and regulation of the clean development mechanism, China’s laws and regulations is still flawed.There are favorable conditions and unfavorable conditions for the voluntary carbon emission reduction in the country. Favorable conditions include:First, the development of voluntary carbon emission reduction is not bound by laws and regulations, but by the parties’ indenture, its development is more flexible; Secondly, Compared with the Clean Development Mechanism voluntary carbon emission reduction costs less, which will help enterprises participate in the trading of carbon emission reduction, and environmental awareness of domestic enterprises is also rising;Finaly, the mechanism of voluntary carbon emission reduction in China has initially formed, the domestic carbon emissions trading exchanges have been established which provide a trading platform for voluntary carbon emission reduction,while there are many advanced foreign experience for China to reference.The adverse conditions of the voluntary carbon emission reduction in China’s development epitomize that the scale of voluntary emission reduction which based on the enterprise voluntary is difficult to promote; all carbon emissions Exchange’s accreditation and certification standards are not uniform, lacking of the law and regulations to regulate, that is not conducive to voluntary emission reduction activities’operation.Based on the above analysis, China which wants to develop low-carbon economic and actively join in the international carbon emissions trading need to build carbon trading mechanism accord with china’s national conditions and coordinate the implementation of the three mechanisms in China and determine the consequence of cap-and-trade in its carbon emissions trading market.There are many favorable conditions for the development of China’s cap-and-trade. Such as the determination of emissions’cap, the state can play an important role by giving policy and legal support; while EU’s advanced experience provide useful lessons for China.Several aspects of China carbon emissions trading need to solve. Include that the confirmation of the cap of emissions and the confirmation of the period target by learning from EU experience. On the scope of carbon emissions trading partners’ determination and the initial allocation of emissions allowance, its should consider the differences between different industries and different areas, to avoid discrimination in industries and regions; while carbon emissions trading should adhere to the common but differentiated responsibility principle, adhere to the principles of the government’s moderate intervention and sustainable development; Ensure that the coordination between carbon-trading laws and regulations and the law itself lag and supervision’s comprehensive, just and orderly.
