Legal System Of Environmental Information Disclosure From The Interaction Perspective Among Subjects

With the ever interiorizing concept of environmental protection and the frequently occurring of environmental accidents, more and more attentions are thrown to the environmental information related to our daily life. Perfect legal system of environmental information disclosure could not only realize the right to know, but also promote governments and enterprises to perform their duties. However, drawbacks of China’s legal system of environmental information disclosure hinder the interaction among different subjects. The theory of environmental interaction among subjects tries to improve this system and offers guidance to lawmakers in order to break away from the dilemmas in legislation.Three parts are included in this paper concerning the legal system of environmental information disclosure from the interaction perspective among subjects.Chapter1begins with the basic theory of environmental information disclosure. It introduces the concept, classification, theoretical foundation and characters of environmental information disclosure. Then the basic theory of environmental interaction among subjects is presented together with regulation relationships and supervision relationships. Later on, this paper proposes conception of legal system of environmental information disclosure under the theory of interaction.In Chapter2, the subject, content, procedure and supervision of environmental information disclosure in China’s legislation are introduced at first in order to show the general legal situation. After that, this paper discusses the drawbacks in legislation from interaction perspective among subjects. Combined with the theory of regulation interaction and supervision interaction, Chapter3tries to perfect the legislation on the basic of the drawbacks forward. This paper gives the following suggestions:1.Determining the subjects of regulation interaction and supervision interaction;2. Determining the environmental information disclosure responsibilities for government and enterprise;3.Confining the exception of environmental information disclosure to a certain scope;4.Providing the public with convenient procedures and ways to protect their right to know;5.Perfecting the provisions about supervision, protection and legal liability.This paper changes the traditional concept in analyzing legal system of environmental information disclosure and introduces the new concept of environmental interaction among subjects initially. With that new concept, different parts of the legal system of environmental information disclosure could be combined into regulation interaction and supervision interaction. The drawbacks and suggestions in legislation are also derived from the perspective of interaction among subjects.
