Public Figures Privacy Restriction System Research

With the development of economy and society, the right consciousness is more and more strong, the right of privacy is one of personality right of citizenship, should be protected by law. At present, our country’s law about the protection of privacy is too indirectly, mostly of the infringement rights of reputation, the right of personality to protect, in judicial practice is difficult to achieve the maximum protection of the right of privacy. The conception of "public figures", our Chinese law does not clearly defined, resulting in judicial practice, there is so much uncertainty. Public figures because their daily life are often associated with the public advantages, the protection of the right to privacy of public figures also has the particularity, more of the time, need to make restrictions on its. How to public figures privacy to make a reasonable limit to meet the public interest, protect and make better has nothing to do with the public advantage of the right of privacy legislation, need further perfection in the judicial practice, is a problem worthy of discussion.In the process of writing this article, we adopt the research method of combining standardized research and empirical research, on the basis of expansion from the theoretical analysis to the logical sequence of empirical test. In this paper, the rich data and based on a large amount of data, through the integrated use of qualitative analysis and quantitative analysis, makes a research from the limitation of the right to privacy of public figures in multiple dimensions. From the main content of the thesis, first of all, this paper followed on the right of privacy, public figure, the right to privacy of public figures and other related concepts. Secondly, the right to privacy of public figures of the legitimacy and limitation are analyzed. Thirdly, this paper examines the protection of the right to privacy of public figures in typical countries and regions. Finally, put forward the legislative suggestion the privacy right of public figures of China limited.
