Since the Professor Li Bu yun advocated the development of legal philosophy,Philosophy of Law began its road of conscious development.Scholars have madecertain achievements, but the number of researcher is still very scarce.Legal philosophyin China has not yet formed the academic atmosphere and traditional of consciousdevelopment. I try to bring up the subject again on the necessity of legal philosophyconsciously development.The article is written in general,but my intentions are good.Ihope to attract more scholars to concern about this issue,and then form a new force tostudy the philosophy of law.In this paper, based on the definition,I try to comment onthis topic from three aspects, they are separate disciplines requirement, the reality of theplight of the requirements, the requirements of the philosophical spirit nature.The papershall contain four chapters, in addition to the introduction and the conclusion. The mainbody of the paper will have more than14,000words and the part of footnote will have600words.The introduction will give an outline of legal philosophy development,and discusstwo ways about it in China.Moreover, this part will point out the Chinese theoreticalcircles not pay enough attention to this issue.Thus, it comes to the conclusion thatChinese legal philosophy needs conscious development.Chapter One, based on the concept of the“Conscious”and“The consciousdevelopment of the Chinese legal philosophy”,will focus on the standards andsignificance of it, which laid the foundation for the following article.Chapter Two will study the concept of Jurisprudence and Philosophy of Law.On thebasis of the origin of two words,the emergence and development of the discipline,theauthor will try to identify the two concepts,and then initially determine the originality ofthe philosophy of law,which requirements of self-awareness.Chapter Three is concentrated on the development dilemma of legalphilosophy,which sum up the academic debate history in China about them. It isdivided into three sections.,just like reasons,performances and consequences.On thisbasis, the author will give a preliminary identification as that philosophy of law needsSelf-reflection. Chapter Four will focus on the Chinese unique spirit of nature in philosophy.Theauthor will give a brief description of philosophy history between Chinese andwestern.The paper further will point out that Western philosophy has made greatdevelopment, but it also faces development dilemma.Chinese philosophy has not yetshown its energy, but it contains a huge value pursuit and superiority...That is tosay,The development of philosophy of law needs to take root in the Chinesetradition.,which needs Self-created.In the conclusion part, the author will generalize the detailed perorations drawnfrom each chapter, and strengthen the significance of the need for development of theChinese legal philosophy.In addition, it would be better to correct and revise theinadequacies occurred in this paper.
