Of humanity, there is a disabled people, disability is inevitable in the history of human society development to a social cost. The disabled employment is to achieve survival and development, improve living standards, equal participation in society, to share a basic way of the material and cultural achievements. Strengthen the legislation of employment for the disabled is one of the important measures to protect and promote the employment for disabled persons.From the perspective of international law, this paper introduces the parts of the disabled employment legislation situation and characteristics. Disabled employment laws protecting ways mainly have the constitution, the anti-discrimination laws, criminal law, etc. National legislation to promote disabled employment the main channels are in proportion to arrange employment for disabled persons, centralized placement employment, encourages obtain employment of the disabled self-employment and public welfare post placement, etc. In the perspective of comparative law, are analyzed from the aspects of legislative ideas and supporting measures in protecting and promoting the implementation of the employment for disabled persons. Such as to eliminate discrimination and reasonable facilities, specialized agencies and the proportion stipulated non-competition, and defense system of economic compensation, the eligibility and employers, etc. Since China’s reform and opening up, in the party and government, under the attention of the society from all walks of life, under the joint efforts of employment for the disabled in our country gradually formed centralized employment, employment in proportion, and individuals from a variety of channels, such as the pattern of many layers jointly promote. Employment for disabled persons got very big improvement. However, the current employment for the disabled is still low employment rate, employment, employment level is not high.To promote disabled employment, China has enacted a series of laws, regulations and policies, this paper has carried on the induction, the disabled employment legislation and policies in China and detailed analysis of its shortcomings, such as legislation slow pace, the level is not high, the terms are not clear, relevant mechanism is not sound, etc. Based on the use for reference the experience of international legislation, on the basis of employment for the disabled in China legislation put forward the integration of resources, to strengthen the construction of legislation study system improve the legislative level, highlight the concept of anti-discrimination legislation optimization recommendations, etc.
