| Freeway management is a newly emerging industry. It has started to develop over the recent20years, but it is developing rapidly. Now, the new term, freeway, becomes a household word and is known to all. More and more people can get the benefits brought by this convenient traffic. As every coin has two sides, more and more problems are arising in the development of freeway. From the point of freeway toll management, the phenomenon of toll evasion and toll dodging are banned but widely practiced. If no measures are taken, the evasion behavior will be more rampant. However, the increasing punishment leads to the fierce contradiction between freeway managers and drivers, which causes a dilemma for freeway operator. It is in such a situation that the regulations of freeway management are introduced by many provinces. People who commit toll evasion and toll dodging will be punished by administrative penalty. But, it is worth considering whether the regulations are reasonable and steady according to the theories of law. At present, freeway operator conducts it in the form of company and freeway management becomes a service. As a result, more and more people doubt the rationality of administrative penalty for the people who commit toll evasion and toll dodging. In this paper, there are five parts: stating cases, the reason and current situation of administrative penalty, the divergences and analyses of punishing the people who commit toll evasion and toll dodging, the measures to prevent freeway toll losing, and conclusion. The third part is the most important one. In that part, two contradict opinions are presented and analyzed from theory and practice view. By this paper, the writer holds that to release contradictions, administrative penalty should be abolished. And, effective measures should be taken to prevent toll losing, to improve traffic environment, to contribute to social harmony, to promote the development of logistics and transportation, and to boost economy. |
