Studies On The Right To Adequate Standard Of Living And Legal Protection

The right to adequate standard of living is a fundamental human right in the provisions of international human rights conventions,meanwhile,the contents of human rights which are enriched continually along with the economic and social development are determined by the feature of openness of human rights.Especially after the Second World War, with the incessant push of the international organizations headed by the United Nations,not only the social,economicand cultural rights of the citizens have been gained the general acceptance by the national legislation in different countries,but also the security practice of the rights even has been made rapid progress.Furthermore,as one important component of the social and economic rights,the right to adequate standard of living has drawn high attention within the theoretical circles and gained great concern by different governments in the world.The nature of rights and the way of guarantee concerning the rights to adequate standard of living have become a heated topic in recent years in the academic field.There are six parts in this paper:The first part focuses on the research significance of the right of the theories and methods used in the study, as well as content and the basic path.The second part has mainly discussed the concept,the characteristic,the process of formation and its associated rights.This part is the premise of this study,as well as set the basis of this study. The third discussed the main content of the right and it made content enrichment to further explore.The fourth part discussed the protection mechanisms from the view of the national and international human rights law perspective.In addition, it summed up the basic pattern of right proteciton in the levels of national and international.This part halps to make theoretical basis in the legislation and pracitce in China.The fifth part detailed the current situation of China in the protection of the right to adequate standard of living from the perspective of legislation and pratctice.The sixth part proposed to the existing problems in the protection of the right,and finally to propose appropriate recommendations for improvement.
