Study Of The Subjectivity Of The Connotation Of The Contemporary Chinese Advanced Legal Culture

The development goal of contemporary China legal culture is the construction of socialist advanced legal culture which has Chinese characteristic, it is based on the Marx principle, and it is in the foundation of critically absorbing outstanding composition of all foreign legal culture and Chinese traditional legal culture, the legal culture is the independent innovation culture in the practice of constructing the socialist of China characteristics as the main content. A kind of advanced culture, which has the value system as the core of the culture mode and relate to the core problem of the legal values——The subjectivity philosophy. The philosophic connotations of advanced legal culture need to have China characteristics and China style, as the core and pillar of socialist advanced legal culture construction enterprise. At present, China has proposed a "people-oriented" ruling idea, there is no doubt that it is the cultural foundation of the rule of law in our thoughts. So, this paper uses "People-oriented" culture concept to examine the legal culture, and study on the legal culture of humanism connotation with the value principles of subjectivity. The study concluded that the concept of rights is a natural extension of citizen’s subject consciousness, and the concept has more reasons to be regarded as the logic starting point of legal culture, it is higher than the justice value and efficiency value of law culture. In this historical process, the key is to give Chinese socialist advanced legal culture subjectivity, establish the value concept of "subject oriented" and make clear the subject status of human. Only in this way, freedom and liberation of people of Marx’s concept of social development can be implemented, and the fundamental purpose and ultimate value about the advanced legal culture construction of our country’s can be implemented too.
