Research On China’s Environmental Protection Administrative Accountability System

Since the reform and opening up, China’s economic development is unprecedented around the world, however, the environmental pollution is the worst.The environmental problems on the surface appear to be caused by industrial pollution, but to search from the original, it’s the problems of supervision and management that does not work in place, which caused by the lack of the necessary environmental protection administrative accountability system.At present, China’s system of environmental protection administration accountability, it is still stormy, randomly, which directly caused the injustice of accountability results.China’s environmental problems are austere, with serious pollution and destruction, for which we should strengthen the responsibility of the environmental protection agency, build and perfect the environmental protection administrative accountability system, and further curb environmental degradation.The"Environmental Protection Law of the People’s Republic of China"(hereinafter referred to as the"environmental protection law"amendment) has been passed by the high votes and approval of the 8th meeting of the 12 th session of the standing committee of the National People’s Congress, which will come into force on January 1, 2015.The revised"environmental protection law ” has further defined the government’s regulatory responsibilities of environmental protection, strengthen the government’s environmental protection responsibility, perfect the supervision and management system of environmental protection, which will better protect the public’s environmental rights and interests. Therefore, the environmental protection law is also known as the most stringent one ever.Under such circumstance, this paper puts forward to some constructive suggestions through analyzing the current situation of domestic existing environmental quality, considering the present situation and existing problems of the environmental protection administration accountability system in our country, combining foreign countries’ environmental protection administrative accountability experience with China’s own national conditions,and drawing lessons from abroad, to perfect our country administration accountability system of environmental protection.This paper consists of introduction, text and epilogue.The text mainly includes four parts.The first part provides an overview of the environmental protection administration accountable.It mainly through the concept of environmental liability for analysis and classification, to study the environmental liability of the Government;the analysis of administrative accountability to further study of the administrative accountability system of environmental protection.The second part is the analysis of the necessity to build environmental protection administrative accountability system.This part from the construction of environmental protection administration accountability system is to improve the environment and the maintenance of public environmental interests inevitable requirement, is the inner requirement of constructing responsible government and implement the inevitable trend of the international responsibility three aspects.The third part is about the study of existing problems of environmental protection administration accountability system in our country.This part mainly includes,1.the main aspects:paying attention to the internal accountability,while despising allogeneic accountability;2.object aspects:the object is unknown, and which has narrow scope;3.legal aspects:environmental protection laws and regulations of administrative accountability are not perfect;4.thoughts:the ideology of accountability is weak;5.the information disclosure aspects:lack of information disclosure mechanism.The fourth part is for some recommendations about improving the environmental protection administration accountability system in China. This part mainly includes, 1.the establishment of diversified environmental accountability mechanism;2.straightening out the supervision and management system of environmental protection;3.perfecting the legal system of environmental protection administration accountability;4.ideological transformation of accountability;5.the construction of strengthening information disclosure mechanism.At present,China’s environmental problems occur frequently, the establishment and improvement of environmental protection administrative accountability system are the trend, this paper aims to analyze the necessity for China to build environmental protection administrative accountability system and the problems of our current environmental administrative accountability system, to propose some suggestions on the construction and improvement of administrative accountability system for environmental protection, in order to promote the process of China’s environmental protection administrative accountability.
