Study On The Government Regulation Of Land Reclamation In The Open Pit Coal Mine In Ordos

Land belongs to public goods, and land reclamation affects the sustainable development of economy society, economic benefit of opencast coal mine land reclamation is not significant. At the same time market mechanism failure requires government intervention. The key process of supervision of opencast coal mine land reclamation of government is a legal, administrative, economic and technical means. The purpose of the government regulation is to protect the national land reclamation law, policies and other effective implementations in effect, and make the exploitation of mineral resources, land reclamation and the development of the economic society in harmony.This paper uses literature research method, a comprehensive survey, expert consultation and field survey method, which introduces the opencast coal mine land reclamation of government regulation theory and related content through comprehensive analysis of Ordos opencast coal mine land reclamation and status of government regulation as follows.First of all, based on the investigation and research on Ordos opencast coal mine land reclamation and government supervision, this thesis combines the. basis of government regulation, land reclamation of Ordos opencast coal mine supervision together, and describes the effectiveness of government regulation of land reclamation in Ordos opencast coal mine. Secondly, the paper puts forward the government supervision problems in five aspects:being not strict in advance, the absence of government regulation and supervision, lack of management and protection purposes, the difficult means to guarantee, information asymmetry, the lack of public participation. Mean while, this paper and analyzes the causes of these problems. Finally, drawing lessons from domestic land reclamation supervision experience, the author put forward some measures:first is to improve the community, especially the government supervision departments and mining enterprises in order to recognize and pay more attention to the management of land reclamation. The second is to improve the laws and regulations of land reclamation in opencast coal mine field, surely,we should strengthen the propaganda about the punishment to make. The third is to improve the management system and the establishment of land reclamation in open pit mine common responsibility mechanism. It is the implementation of departmental responsibilities and the management system, we have to actively carry out land reclamation supervision and inspection, and make it strict implementation of a pre-existing system of land reclamation costs. The fourth is to establish and perfect the land reclamation coordination mechanism, multi-governance mechanism and returning mechanism, strengthen the reclamation treatment. The fifth is to pay attention to the regulation by strengthening the innovation of supervision mode. Land reclamation in opencast coal mine should be an overall plan. We have to improve the governance mode by constructing a new mode of land reclamation supervision, implementation of scientific supervision. The sixth is to strengthen the open final management and protection of coal mine reclamation land, from the long-term development perspective and the proposed mining village construction.According to this study, it is expected to be of some help the Ordos opencast coal mine land reclamation government regulation. At the same time, I sincerely hope that it could be a useful reference to the development of the opencast coal mine lad reclamation in China.
