The Theory Of The System Of Free Evidence Evaluation Of Post-modernism

The content of this thesis is about the establishment and construction of thesystem of free evidence evaluation of post-modernism under the background of theideological trend of post-modernism.This thesis first present a concept andcharacteristics of free evidence evaluation of modernism under the background ofthe Enlightenment,which may be different from the conventional view ofacademia.And then analyzing the advanced nature and contradiction of reason whichis the soul of free evidence evaluation of modernism.And finally it reveals theinstability and none-absoluteness of reason by referencing three great master’s theoryof philosophy or psychology.After that,this thesis continue to analyze the essence ofideological trend of post-modernism，and then it focus on the important point thatreason still has certain basis, certain standard and certain method by referencinganother three great philosopher’s theory of post-modernism.After this,it reveals thepost-modern standpoint about the reason and the truth——"view of consensus truththrough discourse".Under the guidance of this view of post-modernism,this thesisfinally put forward the concept,characteristics and the rule content of "the System ofFree Evidence Evaluation of Post-modernism" which including two aspects of therules.After that,it expounds the "Publicity of Free Evaluation" as the symbol andcore of this post-modern legal system detailedly.At the last,after the wholepost-modern legal system’s structure has been completed，this thesis begin to explorethe possibility and specific implementation that how to applicate this post-modernlegal system into our country’s legal field of civil procedure.All inall,this thesis not merely put forward a new concept about the system ofevidence evaluation——the System of Free Evidence Evaluation ofPost-modernism,but also amend the conventional concept of free evidenceevaluation of modernism.In addition, it also bring forward a new constructiveformulation about the innovation of mode of Cases Distribution in our legalfield.There may be some controversy between the conventional viewpoints and thisthesis’s viewpoints，but all of the viewpoints in this thesis are based on the sufficient demonstration at least.The most important keypoint and the final objective of thisthesis is on the introduction which leads the ideological trend of post-modernisminto the kingdom of the legal world!...
