On the nature of the relationship between higher education is a consumer legal relationship. Dueto the limitations of people’s attitudes lag and the current legislative, judicial and other aspects of thereality of education leading to the legitimate interests of consumers are not effectively protected.Consumer education should enjoy the rights of consumers can not be achieved. Therefore, from howto build a sound educational interests of consumer protection from legislative, judicial, and othercritical.Currently, the field of basic education litigation limited to administrative proceedings,disadvantaged students, students’ legitimate rights and interests are not protected. Therefore, theanalysis of consumer rights protection issues of higher education, to promote sustainable and healthydevelopment of higher education under the new situation is particularly important..On the basis of study and learn from foreign higher education system protection laws andpractices on consumers, China’s higher education needs to improve consumer protection andenhancement. One is to improve the protection of consumers’ interests higher education institutionbuilding laws. Second, the implementation of the Charter of the University and the University of themodern education system construction. Third, the establishment of consumer protection in highereducation relief network.This paper aims to establish preventive measures separately from the above three aspects, and toform an effective, systematic and actionable suggestions to ensure that the legitimate interests ofconsumers in higher education, building a harmonious higher education consumption environment,promote the development of China’s higher education cause.
