Receach On The Demonstration Right In A Transformation Society

As a basic citizen rights,the demonstration right is a form of freedom of expression.A lot of demonstrations have been far beyond boundaries to morph into looting in the real world.Demonstration is a sort of legal express,by which citizen express their inner demands to the government and society.But the improper exercise of demonstration would destruct the social order, trample the law and cause serious problems for the production and life of other people.Therefore it has important practical significance to research the demonstration right.Mainly aimed at the social transformation period,the researching is divided into four parts in this paper.There are all kinds of special problems in the social transformation.For dealing with following problems as the improvement of citizens’ legal and democratic consciousness, the growing material and cultural needs, demonstration must be got more and more attention. In the first part, The basic definitions of demonstration should be talked, including the historical origin, concept and basic components. In the second part, the value of the theory will explain the fundamentality and importance of the right by discussing the basic of demonstration right. The third part will analyze the problems in the legislation and express the author’s point of view. In the last part, the author put forward a proposal, practically, which will help to protect the demonstration right in the aspect of legislation.In China, for the factors of the state, society, history and citizen themselves,the demonstration has specially characteristic.We need to take the problem into a global circumstance, and also must not be removed the actual conditions of China.In order to guide citizens to express their requirements and exercise their rights correctly, the author analyzes the right to demonstration profoundly through uncovering the veil of the demonstration.
